The Office of the Director of Public Prosecutions (DPP) has called on the Court of Appeal to reject an appeal lodged by Godfrey Wamala, alias Troy, challenging his 14-year prison sentence related to the death of singer Moses Ssekibogo, known as Mowzey Radio.
State Attorney Joseph Kyomuhendo informed the court that Wamala and his legal team have displayed no intent to pursue the appeal. He stated that since filing the notice of appeal, the team has not submitted the necessary documents outlining the grounds for the appeal.
Troy Wamala was convicted in October 2019 by Lady Justice Jane Frances Abodo for manslaughter. The evidence presented suggested that on January 22, 2018, Mowzey Radio visited De Bar in Entebbe with friends, including Troy. A dispute arose after Radio jokingly referred to the bar owner as unable to afford drinks. This provoked an altercation leading to Wamala allegedly hitting Radio, causing fatal injuries.
Radio was taken to multiple medical facilities but succumbed to his injuries at Case Hospital. Wamala evaded authorities but surrendered after Radio's death.
Despite Wamala's appeal, Justice Abodo had previously ruled that he participated in the altercation leading to Radio's death, granting him a 14-year prison term.
Wamala's appeal was set for hearing before a panel of three Court of Appeal Justices. However, Wamala's alleged failure to act on the appeal prompted the DPP's request for its dismissal.
In response, Wamala claimed that he lacked essential court records to prepare a thorough appeal, citing missing evidence from the first prosecution witness. The court granted his request for an adjournment to a later session.
The case continues as both sides await the court's decision on the appeal's fate.
